By accessing this website, booking a consultation, or using any services provided by First Due Systems ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

First Due Systems provides AI-powered business automation services including, but not limited to:
- AI business assessments and audits
- AI voice receptionist deployment and management
- Outbound SMS and voice nurture agent deployment
- Consulting and implementation services
3. SMS Messaging Program
By providing your phone number and opting in to SMS communications, you consent to receive text messages from First Due Systems related to the specific program you enrolled in. Message frequency varies by program.
Standard message and data rates may apply.
To opt out, reply STOP to any message. To get help, reply HELP. For additional assistance, contact thomas@firstduesystems.com.
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier network availability.
4. User Conduct
When using our services, you agree not to:
- Provide false or misleading information
- Use our services for any unlawful purpose
- Interfere with or disrupt our AI systems or infrastructure
- Attempt to gain unauthorized access to any part of our systems

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or that any defects will be corrected. We do not guarantee specific business outcomes from use of our AI systems.
7. Limitation of Liability
To the maximum extent permitted by law, First Due Systems and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, or data, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from use of our services shall not exceed the amount you paid us in the 30 days preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless First Due Systems and Thomas Encinas from any claims, damages, losses, or expenses (including attorney fees) arising from your use of our services or violation of these Terms.
9. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Orange County, California.

We reserve the right to update these Terms at any time. We will indicate the updated effective date at the top of this page. Continued use of our services after changes constitutes your acceptance of the updated Terms.
